In diesem Beitrag möchte ich begründen, warum das 2-Grad-Ziel der internatio- nalen Klimapolitik einen vernünftigen Umgang mit unscharfen Grenzen darstellt. Ich werde zunächst skizzieren, aus welchen Überlegungen das 2-Grad-Ziel ent- standen ist und wie es Eingang fand in die internationale Klimapolitik. Daraufhin werde ich darlegen, dass sich traditionelle Entscheidungsanalyseverfahren (Kos- tennutzenanalyse, kurz: KNA) nicht problemlos auf klimapolitische Fragestel- lungen anwenden lassen. Solche Schwierigkeiten umgeht hingegen der Leitplan- kenansatz, der als Alternative zur KNA entwickelt wurde. Im Leitplankenansatz, so werde ich argumentieren, (...) lässt sich das 2-Grad-Ziel als Klimaleitplanke ein- sichtig begründen. Schließlich werde ich auf ungerechtfertigte Kritik am 2-Grad- Ziel aufmerksam machen. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:174 HISTORY OF PHILOSOPHY (960-1279) was in many aspects one of the most brilliant eras in Chinese history. One sees in this period the improvement of the bureaucratic system, the flourishing of a new poetic genre, the tz'u, a fresh approach to the study of Confucian cla~ics, the advancement of historiography and the rise of Neo-Confucianism. Ou-yang Hsiu (1907-1072) pioneered in all these magnificent political, cultural, and literary achievements. (...) Inevitably, he became a controversial figure to his contemporaries, and to later generations as well. There has not been a complete and balanced study, however, of this well-known and well-remembered man. Perhaps he was too broad and diverse a historical figure to be approached and studied easily. Professor Liu's book deserves our congratulations not merely for its well organized and scholarly presentation, but also for its successful approach to the subject from various angles. Ou-yang Hsiu was an official, a classicist, a political theorist, a historian, an essayist, and a poet. Accordingly this book gives separate chapters on Ou-yang Hsiu the classicist, the his= torian, the political theorist, the master of Sung literature, etc. With profound knowledge and sure control, the author organizes his materials so that the reader will not lose sight of the main points of the study. The best feature of this book (this reviewer feels) is that the author gives equal recognition to Ou-yang Hsiu the man and to the period in which he lived. Professor Liu ably and thoughtfully presents the historical characteristics of the Sung dynasty through Ou-yang Hsiu, and evaluates the merits and shortcomings, accomplishments and hmitations of Ouyang Hsiu against the peculiarity of his time. The subtitle of this book, An Eleventh=Century Neo=Con]ucianist, is most suitable. NeoConfucianism has always been studied abstractly as a philosophy, but Professor Liu's book shows us how this philosophy has been embodied in, substantialized, and practiced by "a key historical figure" who "gives us a finer perspective of his whole era." The second volume of the Edition Alqui~ confirms what was said here when Volume I appeared (JHP, II [1964], 260f.): this edition supersedes all currently available study editions. Volume II continues the rigorously chronological arrangement which singularly suits the philosophical writings of Descartes' "metaphysical period." Like no other edition, this one illuminates the often forgotten character of Descartes' philosophizing as an interaction between an ongoing dialogue (correspondence and replies to critics) and rigorously systematic thought. Imbedded in the stream of letters we find the Meditations not as a monolithic block, but as a sequence of three publications: the Latin text inserted at the time-point of its completion, April 1640; the French text with the first six Objections and Responses, August 1641; and at the end of the volume, the Seventh Objections and Responses and the letter to Diner. Only the Objections of Gassendi and Bourdin have been slightly cut. The volume concludes with the Recherche de la v~rit~ of unascertainable date (Aliqui~ thinks that it fits best into the 1641-42 context, without insisting on his conjecture). We thus have an edition that allows us to read the Meditations as Descartes' contemporaries---friends and adversaries --did. Once again the editor's notes are admirable, and there are brief but important critiques of the revised AT volume containing the Meditations, based on source studies by the editor, Henri Gouhier, and by Leslie J. Beck. Zwischen der späten Weimarer Republik und der frühen Bundesrepublik wurde der Begriff ›Humanismus‹ in der Publizistik so oft verwendet wie nie zuvor. Intellektuelle aus unterschiedlichen Milieus verstehen den Zusammenbruch der Weimarer Demokratie und den Nationalsozialismus nicht allein als politisch-soziale Krise, sondern als Krise der Kultur. Die Berufung auf den Humanismus dient dabei oft als eine Art ›Bollwerk‹ gegen den ›Biologismus‹ und den als ›Nihilismus‹ kritisierten Werterelativismus der Moderne. Zugleich wird der klassisch-idealistische Humanismus selbst als krisenhaft und revisionsbedürftig angesehen, woraus sich (...) die Forderung nach einem neuen Humanismus ergibt. In 2012, a U.S. Institute of Medicine report called for a different approach to health care: “Left unchanged, health care will continue to underperform; cause unnecessary harm; and strain national, state, and family budgets.” The answer, they suggested, would be a “continuously learning” health system. Ethicists and researchers urged the creation of “learning health organizations” that would integrate knowledge from patient‐care data to continuously improve the quality of care. Our experience with an ongoing research study on atrial fibrillation—a trial known (...) as IMPACT‐AFib—gave us some insight into one of the challenges that will have to be dealt with in creating these organizations. Although the proposed educational intervention study placed no restrictions on what providers and health plans could do, the oversight team argued that the ethical principle of beneficence did not allow the researchers to be “bystanders” in relation to a control group receiving suboptimal care. In response, the researchers designed a “workaround” that allowed the project to go forward. We believe the experience suggests that what we call “bystander ethics” will create challenges for the kinds of quality improvement research that LHOs are designed to do. (shrink)

The concept of history employed by Alberti, which lends itself to many interpretations, is approached from the reflections of Erwin Panofsky about the prospect as “symbolic form”, moving towards a hypothesis about the symbolic nature of the configuration and representation of time in the alberti’s window. Vertreter*innen 'kontinentaler' Theologie sehen sich dadurch zu einem Metadiskurs über die Frage herausgefordert, wie Theologie heute grundsätzlich zu formatieren ist. In diesem Band treten Positionen zum ersten Mal in einen direkten argumentativen Austausch.

Diese Arbeit, die das Thema der Sklaverei im Werk der großen Kappadokier behandelt, leistet einen Beitrag zu der heute immer mehr an Bedeutung gewinnenden Sozialgeschichte der Spätantike. Die besondere Leistung dieser Arbeit liegt in der sorgfältigen minutiösen Sammlung aller Belege zum Thema Sklaverei, die der Vf. unter Zuhilfenahme elektronischer Mittel (nach Angaben des Vf.s u.a. des TLG) gesucht und in ihrem von ihm erfolgreich rekonstruierten geschichtlichen Hintergrund interpretiert hat. Yet, the legal doctrines of consent and informed consent differ in their applications. In patient care, the judicial doctrines of consent and informed (...) consent are disclosure doctrines based on the obligation of physicians to inform their patients of the following types of information: the nature of the procedure the physician is recommending in the patent’s care (P), the alternatives to the physician‐recommendation (A), and the risks of procedure and its alternatives (R). In addition, the physician must provide truthful answers to the patient’s questions (Q) to the best of the physician’s abilities. In research on humans, the onus of disclosure by study sponsors and principal investigators is much greater than in patient care precisely because the purpose of research is not patient care. The purpose of research is the identification and development of new generalizable knowledge. Thus, participation in a research study or trial may not benefit the study volunteer at all. In addition, the participant may carry a heavy risk burden in relationship to any testing of a newly designed drug or device as part of their experiences in the research study. Presently, despite the risks borne by the research study participant, the raw data collected from volunteers in research trials are treated by courts as if they were the private property of the study sponsor rather than generally owed to the public as would be expected by an effort like research participation aimed at contributing to the development of generalizable knowledge. This paper reviews the obligations that study sponsors owe to their study participants based on the very definition of research as a systematic activity whose purpose is to develop generalizable knowledge to help all humans. Counterpoint Arguments The following are counterpoint arguments that need to be appreciated to more fully understand the concepts that impact the thesis that ‘raw data’ should be open to the public to allow the opportunity of checking of the results of its associated scientific paper and for further analysis. De‐Identified (Anonymized) Raw Data A current approach to identifying (anonymizinig) raw data is based on the Health Insurance Portability and Accountability Act (HIPAA) of 1996 (P.L.104‐191). HIPAA was enacted by the U.S. Congress in 1996 to keep a person’s medical information private. In a research study, a person’s private medical information can become research data. HIPAA’s Privacy Rule allows a covered entity to de‐identify data by removing all 18 elements that could be used to identify the individual or the individual’s relatives, employers, or household members; these elements are enumerated in the Privacy Rule. The covered entity must also have no actual knowledge that the remaining information could be used alone or in combination with other information to identify the individual who is the subject of the information. Under this method, the identifiers that must be removed are the following: 1 Names. 2 All geographic subdivisions smaller than a state, including street address, city, county, precinct, ZIP Code, and their equivalent geographical codes, except for the initial three digits of a ZIP Code if, according to the current publicly available data from the Bureau of the Census: 2a. The geographic unit formed by combining all ZIP Codes with the same three initial digits contains more than 20,000 people. 2b. The initial three digits of a ZIP Code for all such geographic units containing 20,000 or fewer people are changed to 000. 3 All elements of dates (except year) for dates directly related to an individual, including birth date, admission date, discharge date, and date of death, and all ages over 89 and all elements of dates (including year) indicative of such age, except that such ages and elements may be aggregated into a single category of age 90 or older. 4 Telephone numbers. 5 Facsimile numbers. 6 Electronic mail addresses. 7 Social security numbers. 8 Medical record numbers. 9 Health plan beneficiary numbers. 10 Account numbers. 11 Certificate/license numbers. 12 Vehicle identifiers and serial numbers, including license plate numbers. 13 Device identifiers and serial numbers. 14 Web universal resource locators (URLs). 15 Internet protocol (IP) address numbers. 16 Biometric identifiers, including fingerprints and voiceprints. 17 Full‐face photographic images and any comparable images. 18 Any other unique identifying number, characteristic, or code, unless otherwise permitted by the Privacy Rule for re‐identification. Even though ‘raw data’ can be de‐identified (anonymized) so that there is no way to trace back the data to the study participant from which it was drawn, there are still questions whether the ‘de‐identified raw data’ can be given to other researchers or made public without the original study participant’s approval. It may be the case that this approval could be done at the start of any research study where the individual considering study participation would be counseled on what the process of de‐identification consists of and would be asked whether the participant would allow use of the data by other researchers or made available to the public in a de‐identified state. However, there may be questions of the study participants as to whether the data are truly de‐identified and untraceable back to the study participant since the participant would not be able to see the process actually being carried out in detail in all relevant circumstances. Using Raw Data in Context Simply being in possession of raw data is never enough to build on that data from a research perspective. Researchers need to understand the context of the scientific research study in which the data were collected. This research context includes (but is not limited to): (i) the scientific hypothesis of the research study, (ii) the inclusion and exclusion criteria selected by the research designers of the study to determine which study participants were included and which were excluded from the study, (iii) the methods used to collect the data and possibilities of errors in the data collection processes, and (iv) answers to questions regarding whether any data were excluded from the study data and why these data were excluded. Ownership Rights Over Data There are ownership rights over data. Ownership rights include court decision making related to the question which parties are to be considered as the owners of the data. Possible owners here include (but are not limited to) (i) the study sponsor whose only role was to fund that study, (ii) the principal investigator(s) who developed the scientific hypothesis, and (iii) individual study participants through special contracts made by individual participants who negotiate such contracts with study sponsors and principal investigators to share in the ownership of data. Examples of such data are participant sources of unique gene lines or unique cell lines to be used in future research. Objections to Data Sharing Finally, individual researchers may simply object to sharing data. A researcher’s arguments here may be simply stating that he or she has a right to fully analyze the data since the collection of the data was the researchers’ idea in the first place. These researchers may argue that they have the right to mine the data as fully as they can before deciding to make the data open to the public for others to analyze. The overall goal of this target article is to demonstrate a mechanism for an embodied cognition. The particular vehicle is a much-studied, but still widely debated phenomenon seen in 7–12 month-old-infants. In Piaget's classic “A-not-B error,” infants who have successfully uncovered a toy at location “A” continue to reach to that location even after they watch the toy hidden in a nearby location “B.” Here, we question the traditional explanations of the error as an indicator of infants' concepts of objects (...) or other static mental structures. Instead, we demonstrate that the A-not-B error and its previously puzzling contextual variations can be understood by the coupled dynamics of the ordinary processes of goal-directed actions: looking, planning, reaching, and remembering. We offer a formal dynamic theory and model based on cognitive embodiment that both simulates the known A-not-B effects and offers novel predictions that match new experimental results. The demonstration supports an embodied view by casting the mental events involved in perception, planning, deciding, and remembering in the same analogic dynamic language as that used to describe bodily movement, so that they may be continuously meshed. We maintain that this mesh is a pre-eminently cognitive act of “knowing” not only in infancy but also in everyday activities throughout the life span. Reflective equilibrium ("RE", for short) is a method of justification which works roughly as follows: We start with our pre-theoretical judgements (about, e.g. moral issues) and try to explain them by a systematic theory. This leads to a process in which judgements and principles are mutually adjusted to each other until a state of equilibrium is reached. For more than half a century, RE has been very popular, as well as controversial, among philosophers of many persuasions. Given how frequently the (...) method is mentioned, embraced and attacked, it is surprising that only very few attempts have been made at analysing and developing RE in detail. This topical collection brings together papers that develop RE on a conceptual level, analyse it using formal methods or investigate applications of RE. (shrink)

Die Unverzichtbarkeit der Beratung bzw. Prüfung einer medizinischen Studie durch eine Ethikkommission ist weithin anerkannt. Dennoch sind Forschungsethikkommissionen immer wieder der Kritik, z.B. nach mehr Effizienz, Transparenz oder Konsistenz ausgesetzt. Evaluationsinstrumente für Ethikkommissionen beinhalten oft implizite Vorstellungen „guter“ Qualität. Aus ethischer Sicht sind vor allem der Schutz der Versuchsperson und eine vertretbare Schaden-Nutzen-Bewertung wichtig. Der interdisziplinäre Sammelband geht der Frage auf den Grund, wie sich eine Qualitätsverbesserung aus ethischer Sicht gewährleisten und umsetzen lässt. AI/ML increasingly impacts the ability of humans to have a good life. Various sets of indicators exist to measure well-being/the ability to have a good life. Students play an important role in AI/ML discussions. The purpose of our study using an online survey was to learn about the perspectives of undergraduate STEM students on the impact of AI/ML on well-being/the ability to have a good life. Our study revealed that many of the abilities participants perceive to be needed for having (...) a good life were part of the well-being/ability to have a good life indicator lists we gave to participants. Participants perceived AI/ML to have and continue to have the most positive impact on the ability to have a good life for disabled people, elderly people, and individuals with a high income and the least positive impact for people of low income and countries from the global south. Regarding indicators of well-being and the ability to have a good life given to participants, we found a significant techno-positive sentiment. 30% of respondents selected the purely positive box for 28 of the indicators and none did so for the purely negative box. For 52 indicators, the purely negative was below 10% (not counting the 0%) and for 10 indicators, none selected purely negative. Our findings suggest that our questions might be valuable tools to develop an inventory of STEM and other students’ perspectives on the implications of AI/ML on the ability to have a good life. This contributed volume is the result of a July 2010 workshop at the University of Wuppertal Interdisciplinary Centre for Science and Technology Studies which brought together world-wide experts from physics, philosophy and history, in order to address a set of questions first posed in the 1950s: How do we compare spacetime theories? How do we judge, objectively, which is the “best” theory? Is there even a unique answer to this question? -/- The goal of the workshop, and of this book, (...) is to contribute to the development of a meta-theory of spacetime theories. Such a meta-theory would reveal insights about specific spacetime theories by distilling their essential similarities and differences, deliver a framework for a class of theories that could be helpful as a blueprint to build other meta-theories, and provide a higher-level viewpoint for judging which theory most accurately describes nature. But rather than drawing a map in broad strokes, the focus is on particularly rich regions in the “space of spacetime theories.” -/- This work will be of interest to physicists, as well as philosophers and historians of science working with or interested in General Relativity and/or Space, Time and Gravitation more generally. This volume offers a broad, philosophical discussion on mechanical explanations. Coverage ranges from historical approaches and general questions to physics and higher-level sciences . The contributors also consider the topics of complexity, emergence, and reduction. Mechanistic explanations detail how certain properties of a whole stem from the causal activities of its parts. This kind of explanation is in particular employed in explanatory models of the behavior of complex systems. Often used in biology and neuroscience, mechanistic explanation models have been often (...) overlooked in the philosophy of physics. The authors correct this surprising neglect. They trace these models back to their origins in physics. The papers present a comprehensive historical, methodological, and problem-oriented investigation. The contributors also investigate the conditions for using models of mechanistic explanations in physics. The last papers make the bridge from physics to economics, the theory of complex systems and computer science . This book will appeal to graduate students and researchers with an interest in the philosophy of science, scientific explanation, complex systems, models of explanation in physics higher level sciences, and causal mechanisms in science. International framework agreements represent a new generation of transnational agreements between multinational companies and global trade union federations. This paper analyzes the impact of such an agreement on a successful union organizing campaign in Colombia in 2012. We argue that management strategies towards corporate social responsibility and social dialogue influence the impact of IFAs on worker rights. However, this relationship is mediated by the capacity of managers and worker representatives at multiple levels to mobilize their capabilities. The results highlight the (...) importance of institutionalized dialogue between managers and worker representatives, of the dissemination of capabilities across multilevel coordination structures and, most importantly, of their complementarities at various levels. Objective: The present study examines the validity of 11 new Holtzman Inkblot Technique indices. These were chosen from Exner’s Comprehensive System indices using two criteria: first, they had to be valid according to meta-analysis, and second, they must be computed using the HIT standard scoring system.Methods: Both techniques were administrated with a retest interval from 1 to 7days to a sample of 139 subjects from the general population. The validity of the new indices was studied through Pearson correlation with the (...) corresponding RCS indices.Results: Nine of the 11 new indices showed significant correlations with Rorschach scales, confirming our hypotheses. The correlation ranged from a minimum of 0.144 to a maximum of 0.414.Conclusions: The results provide support for the validity of the new HIT indices and have important implications for both clinical and research fields. Susan Cartier Poland Gene patenting--the very notion sounds absurd! How can anyone claim to have invented the genes with which one is born? To make matters worse, genetic makeup precedes birth, meaning the existence of the invention predates the existence of the inventor. So, do we really (...) own our genes, or do they belong to our parents, or our governments, or a Supreme Being? Ownership is only one bioethical issue involved in gene patenting. But before looking at the issues, some essential and basic terms must be understood, namely genes and patents. Genes In his book On the Origin of Species, published in 1859, the biologist Charles Darwin proposed a theory called "natural selection," whereby living things changed over time or evolved through generations due to competition and variation. By experimenting with the garden pea in the 1860s, Gregor Mendel, a monk and accomplished horticulturalist, provided the mechanism of inheritance supporting the natural selection theory of his contemporary Darwin. That mechanism is the gene, or, as Mendel described it, a discrete "factor." The gene has also been defined as "the fundamental unit of heredity" (United States 1987, p. 157). Each individual has two copies of a gene, one from each parent, but that individual passes down to offspring only one of the two copies. Because of Mendel, the gene has become a scientific concept and the basis of a new scientific field: genetics.David C. Page (2000) of the Whitehead Institute for Biomedical Research at the Massachusetts Institute of Technology explained today's terms for genetics structures using an analogy taken from the home. In his view, the cell is a kitchen, the genome is a shelf in the kitchen, the chromosome is a cookbook on the shelf, the gene is a recipe in the cookbook, and a base-pair (either adenine with thymine or guanine with cytosine) is a single letter in the recipe. This book shows that classic Chinese philosophy is as rational as Western approaches dealing with the problems of logic, epistemology, language analysis, and linguistic topics from a philosophical point of view. It presents detailed analyses of rational and methodological features in Confucianism, Taoist philosophy, and the School of Names as well as Mohist approaches in classical Chinese philosophy, especially in regard to ideas of valid knowledge. The authors also provide new arguments against cultural relativism and antirational movements like religious fundamentalism (...) that do not pay due attention to what all human beings have in common-- to cultural universals. Up until the present day, Confucianism has been a major factor in the normative discourses of East Asia. At first glance, it has sided with the preservation of the old and against innovation, according to Confucius’s self-declaration that he “only transmits and creates nothing new.” This also describes the historical role that Confucianism in distinction to other philosophies has actually played over long stretches of time. Nevertheless, Confucian ethics contains structural features, figures of thought and ideas which point beyond mere (...) traditionalism. They reflect the deep crisis of tradition against the background of which Confucianism came into existence and which has left its mark on it. They could set free a dynamic that made it possible to distance oneself from the Confucian tradition within this tradition itself and open it up to something new, if not in terms of its creation then at least in terms of its acceptance and support. This potential also intrinsically relates to the possibility of a “modern” Confucianism. The following three short essays do not claim to give a comprehensive account of the outlined problematique. It is only intended to throw a light upon some of the corresponding thought formations that developed in ancient China and explore by a few examples the extent to which the said potential has actually been realized in later Confucian discourse in Korea and Japan, assuming that border crossing might be among the factors to unleash it. How was the hypothetical character of theories of experience thought about throughout the history of science? The essays cover periods from the middle ages to the 19th and 20th centuries. It is fascinating to see how natural scientists and philosophers were increasingly forced to realize that a natural science without hypotheses is not possible.

We show constructively that every quasi-convex, uniformly continuous function \ with at most one minimum point has a minimum point, where C is a convex compact subset of a finite dimensional normed space. Applications include a result on strictly quasi-convex functions, a supporting hyperplane theorem, and a short proof of the constructive fundamental theorem of approximation theory.

Die Frage nach der universalen Gültigkeit der Menschenrechte ist nicht nur ein akademisches Problem. So steht sie auch immer wieder im Zentrum erbitterter internationaler politischer Auseinandersetzungen. Dabei kritisieren nicht nur Despoten die Ansprüche auf Allgemeingültigkeit als verdeckten Kulturimperialismus und kaschiertes Hegemonialstreben. Wie jedoch jeder weiß, kann ein Schutz der Menschenrechte zur Überlebensfrage werden. Zu aller Zeit und in allen Kulturen waren Menschen nur zu schnell zur Grausamkeit bereit. Two recent hypotheses have proposed that non‐green plant colouration evolved as a defence against herbivores, either as protective colouration promoting handicap signals indicating plant fitness or by undermining their crypsis. The handicap hypothesis posits a co‐evolutionary process between plants and herbivores, whereas the anti‐crypsis hypothesis suggests that an arms race between insects and plants is the evolutionary mechanism. Both explanations assume that insects are the evolutionary origin causing plants' colouration. Here, we propose a different hypothesis, termed the “Defence Indication hypothesis”. (...) This idea focuses on the multiple protective functions of anthocyanins and carotenoids as pigments, and suggests that plant colouration evolved primarily in response to various stressors. Because pigments and defensive compounds share a common biosynthesis, the production of pigments also provides elevated defensive strengths against herbivores, a process termed priming. In effect, the Defence Indication hypothesis predicts that pleiotropic effects of the pigments and, more generally, plants' shared defence responses, explain why insects might react to plant colouration. Covering a topic that draws the attention of a broad public and is gaining importance amongst legislators, practitioners and scholars all over the globe, the book examines the various aspects of whistleblowing. It looks at what kind of legal protection of whistleblowers is in force, who is protected, what kind of behaviour is protected, and what kind of behaviour whistleblowers are protected against. (...) The article tries to prove that the famous formula "epekeina tês ousias" has to be understood in the sense of being beyond being and not only in the sense of being beyond essence. We make hereby three points: first, since pure textual exegesis of 509b8–10 seems to lead to endless controversy, a formal proof for the metaontological interpretation could be helpful to settle the issue; we try to give such a proof. Second, we offer a corollary of the formal proof, (...) showing that not only self-predication of the form of the Good, but of any form is not possible, that is: no form of F has the form of F. Third, we apply Spinoza’s distinction between an ens imaginarium and a chimaera to Plato’s Idea of the Good. (shrink)

In this paper we analyse in the framework of constructive mathematics (BISH) the validity of Farkas' lemma and related propositions, namely the Fredholm alternative for solvability of systems of linear equations, optimality criteria in linear programming, Stiemke's lemma and the Superhedging Duality from mathematical finance, and von Neumann's minimax theorem with application to constructive game theory.

Legal tech is growing, and its growth provokes anxieties about the future of the legal profession as such. In this article, we examine the impact of legal tech on the central role of lawyers at law firms in crafting an imagined ‘right legal answer’ by drawing on Duncan Kennedy’s suggestion that a claim to the rightness of one’s legal propositions is a central characteristic of the legal profession. We first ask how changes in the organisation of legal services affect the (...) ability of lawyers at law firms to produce that ‘right legal answer’. While legal tech only exacerbates already ongoing processes of eradication of routine tasks, we find that it continues to mask the role of ideology in arriving at a right legal answer under a new layer of technological projection. Second, we ask how lawyers’ ability to produce ‘the right legal answer’ is affected by, first, expert systems and, second, a legal tech application named Bryter, representing a no-code system. We find that expert systems do not permit to uphold the unity of the lawyer required for Kennedy’s model of the right legal answer, but that no-code systems as Bryter do so. No-code systems can be reduced to a slogan: Have the lawyer, but evict her ideological temptations more efficiently than before! (shrink)

Das traditionelle Selbstverstandnis des Menschen in der westlichen Kultur ist gekennzeichnet von dem Dualismus von Natur und Kultur oder Korper und Geist. Demgegenuber fassen neuere Konzeptionen des "verkorperten Geistes" (embodied mind) zunehmend die Wechselwirkungen von biologischer, anthropologischer und kultureller Evolution ins Auge. Damit dynamisiert sich der traditionelle Gegensatz von Natur und Kultur zu einem Prozess, in dem die beiden Momente ineinander verschrankt sind und sich wechselseitig bestimmen. Auf dieser Basis lasst sich die Kontinuitat der menschlichen Evolution als stufenformige Transformation der (...) gesamten korperlichen Struktur des Lebewesens Mensch begreifen. Der Band vereint geistes-, kultur- und naturwissenschaftliche Perspektiven auf unterschiedlichen Ebenen und Zeitskalen der menschlichen Entwicklung und tragt damit zur Grundlegung des neuen Forschungsgebiets einer Interdisziplinaren Anthropologie bei.
